Proposed ESCO Energy Savings Improvements for:

Sparta Township Public Schools

Notice is hereby given that sealed bids are sought and requested by Honeywell Building Solutions (hereafter referred to as “ESCO”), for two energy saving retrofit contracts for Sparta Township Public Schools in the County of Sussex, NJ. Bidders should be advised that the scope of work in the specification sets is for turnkey construction services which include audit and design work as well as construction. So much so that each contractor bidding for this work must have the ability to both:

Tender documents were prepared by Spiezle Architectural Group and can be viewed at their office at 1395 Yardville Hamilton Square Road, Suite 2A, Hamilton, NJ 08691.

From Thursday, October 27, 2022, complete sets of tender documents will be available via WeTransfer at no cost to the bidder. Offers will be received until 11:00 a.m. local time in effect on Thursday, November 17, 2022, at the Sparta Township Public Schools Board office conference room located at 18 Mohawk Ave Sparta, NJ 07871. Offers, using Bid forms as prepared by the Engineer may be submitted in person, by post or by courier prior to this date. Any offer sent by post or delivery service is at the sole risk of the bidder. No bids will be received by facsimile or electronic transmission. It is expressly understood that the Bidder is responsible for delivering bid proposals to the Sparta Township Public Schools Board office by the time and date set for the opening of bids. Any bids received after the closing time will be returned unopened. To be considered, offers must be sealed and the outer envelope clearly marked, specifying the ECM of the appropriate main offer:

A pre-bid meeting and site visit is scheduled for the project on Thursday, November 3, 2022, beginning at 3:30 p.m. at Sparta High School located at 70 W Mountain Rd, Sparta, NJ 07871. Given current circumstances necessitating distances and appropriate personal protective equipment, inspection visits will be carried out in a way that ensures the safety of participants. Meet at the main entrance. Although not compulsory, attendance is highly recommended. All attendees must bring valid photo ID and log in at the main school office. The deadline for submitting questions to the Engineer is Friday, November 4, 2022 at 11:59 p.m. The addendum must be communicated to all registered bidders and can be obtained directly from the Engineer’s office on Monday, November 7, 2022.

Bids will be received from one prime contractor for one price per ECM, all trades, all inclusive. Bidders must be prequalified by the New Jersey Department of Treasury, Division of Property Management and Construction in accordance with NJSA 18A:18A-27, et. after.

In accordance with NJSA 18A:18A-26, in order to be eligible to submit a bid for the project, the bidder must be classified by the New Jersey Department of Treasury, Division of Property Management and Construction in the following disciplines:

ECM-2: (C032) – HVAC

(C047) – Electrical

ECM-4: (C008) – General Construction

(C009) – General Construction/Alterations and Additions, or

(C017) – Insulation

No changes to the attached instructions to bidders, general conditions, additional conditions or specifications will be permitted prior to acceptance of the bid. Bids that propose modifications or substitutions to the requirements stated in the Project Manual will result in the rejection of the bid as non-compliant.

Bidders must submit NJ business registration, New Jersey Department of Treasury, Division of Property and Construction Management (DPMC) prequalification/classification certificate for the contractor and all major subcontractors and a affidavit as to the total amount of uncompleted contracts for the contractor and all major subcontractors.

Bidders are required to comply with the Public Works Contractors Registration Act, Chapter 238, Public Laws (NJSA 4:11-56.50 et seq.), and must submit with the bid, proof of registration contractor and prime subcontractor to the New Jersey Department of Labor, Wage and Hour Compliance Division.

Bidders are required to comply with the requirements of NJSA 10:5-31, et seq., NJAC 6:4-1.6 and NJAC 17:27.

The tender must comply with the applicable requirements of the “Public Schools Contracts Act”, NJSA 18A:18-1 et seq. and NJSA 18A:7G-1 et seq., the “Educational Institutions and Construction Finance” Act. No offer may be withdrawn for a period of sixty (60) days after the opening date. The Board reserves the right to reject all bids and/or waive any formality in the tender, as permitted by law, if it is in the interests of the Board to do so. The contract will be awarded to the lowest responsible bidder as defined in NJSA 18A:18A-2.

Pursuant to the “Public Works Contractors Registration Act,” NJSA 34:11-56.50 et seq., bidders and their subcontractors must be registered with the New Jersey Department of Labor and have current certification from that department. indicating the Act at the time of bidding.

Bids must be accompanied by a bid security in the form of (1) a bid bond or certified check or cashier’s check payable to ESCO equal to 10% of the bid amount, but in no event exceeding $20,000.00 pursuant to NJSA 18A:18A-24 and (2) Surety Consent Certificate pursuant to NJSA 18A:18A-25.

The successful bidder will be required to provide additional bonds as specified in Section 002113 – Instructions to Bidders.

ESCO AND THE SPARTA TOWNSHIP PUBLIC SCHOOLS RESERVE THE RIGHT TO REJECT ALL SUBMISSIONS, TO WAIVE ANY CONSEQUENTIAL DEFECTS IN ANY SUBMISSION, OR TO AWARD SEPARATE CONTRACTS OR A LUGGAGE CONTRACT (IF ANY), IN THE MANNER WHO SHALL, IN THE JUDGMENT OF THE SCHOOL DISTRICT, BE DEEMED IN ITS BEST INTERESTS, ALL IN ACCORDANCE WITH LAW.
